Apply for Criminal Rehabilitation at the Sydney Office
To make an application for Rehabilitation to the Sydney office if you are inadmissible to Canada under A36(1)(b) or A36(2)(b) of Canada's Immigration and Refugee Protection Act and are eligible to apply, you must:
- Complete and submit the application form for Criminal Rehabilitation IMM 1444 - PDF * (227 KB)
- Attach two photographs
- Attach a photocopy of your passport information page.
- Attach a non-refundable processing fee as per the visa processing fees schedule on this site. For A36(2)(b) cases you are required to attach the 'criminality' fee. For A36(1)(b) cases you are required to attach the "Serious criminality" fee. Payment methods are explained in detail on the visa processing fee schedule of this website. DO NOT COMPLETE/ INCLUDE A CREDIT CARD RECEIPT FOR PAYMENT, this office does not have credit card facilities.
- Include original Police certificates from the police authorities in all countries (including Canada) where you have lived or been convicted since the age of 18. Please refer to Instructions for obtaining Police certificates
- Include a copy of the police arrest report detailing your offence (please contact the police station dealing with your case).
- Include a copy of the court/ bench transcripts detailing the disposition of your case (If your case went to court).
- Provide copy of the specific section(s) of law under which you were charged.
- Include detailed narrative wherein you explain the circumstances of the offence(s).
- Tell us why you consider yourself rehabilitated. Provide as much information as possible. (e.g.attended drug rehabilitation program, employment history, community service, etc.)
- Attach at least three (3) reference letters from upstanding members of your community, who are aware of your conviction/s and make specific reference to the conviction/s in each letter of reference, attesting to your character.
- Once this information is received it will be reviewed by a visa officer. There is no guarantee that any application for rehabilitation submitted will be successful and you should not make any travel plans until you have advice from this office. This office may require further information from you and you may be required to update relevant police certificates before your application can be finalised.
- Processing time for A36(1)(b) type cases is a minimum of 12-18 months.
- Processing time for A36(2)(b) type cases is a minimum of 4-6 weeks.
